What this is about
These terms apply to the Gathery app and the camera for guests. Hosts create events in the app, guests take photos in the browser through the event's link or QR code. Only the host of the event sees the photos. By creating an account or taking photos with the camera you accept these terms.
Gathery is provided by Jan-Philipp Hansen, Kaiserstraße 41, 76131 Karlsruhe, Germany (legal notice). Gathery is free of charge.
Prohibited content
Do not upload photos that
- break the law, for example depictions of child sexual abuse, glorification of violence or symbols of banned organizations,
- show nudity or sexual acts,
- show, threaten or call for violence,
- demean, threaten or harass people because of their origin, religion, gender, sexual orientation, disability or other characteristics,
- infringe the rights of others, such as copyright, trademarks or personality rights,
- show people who did not agree to the photo, especially in private or intimate situations.
Private parties only
Gathery is meant for private celebrations such as birthdays, weddings or barbecues. You may not use Gathery for events of companies, clubs or other organisations.
Minimum age
You must be at least 18 years old to create an account or use the camera.
As a host
Before your guests take photos, tell them that their photos end up with you and that you can view and download them after the event. Only share the link or QR code with guests who are at least 18 years old.
Behavior
- Share the link or QR code of an event only with the guests of that event.
- Do not upload ads, spam or photos unrelated to the event.
- Do not try to get around Gathery's limits and safeguards.
Your photos
Your photos remain yours. So that Gathery works, you allow us to store them, create previews of them and make them available to the host of the event to view and download. This permission ends when the photo is deleted; we may keep reported photos until we have reviewed them.
You allow the host to use your photos for private purposes, for example to keep them and share them with the guests of the event. For any other use, such as posting them publicly or using them for advertising, the host needs your consent and that of the people in the photo.
Reports and consequences
Hosts can delete any photo of their event in the app, or delete it and report it to us. They can also stop the uploads of an event: the previous link and QR code then no longer work.
We review reported photos and delete content that violates these terms. If there are signs of a crime, we may pass content on to the competent authorities; if people's life or safety is at risk, we inform them immediately. We may suspend or delete accounts that violate these terms seriously or repeatedly.
We review reported photos manually and do not use automated systems for this. If we delete content or suspend an account, we tell the person concerned what we did and why, as far as we can reach them. Camera guests are anonymous, so we cannot notify them. If you disagree with a decision, write to us and we will look at it again.
Contact for reports
Does a photo show you without your consent or infringe your rights? Write to us at support@gathery.de and, if possible, name the event and when the photo was taken. We will get back to you as soon as possible.
You can also report other illegal content here; tell us where the content can be found (for example the event and the time the photo was taken), why it is illegal, your name and your email address, and confirm that your information is correct to the best of your knowledge. We confirm receipt and tell you how we decided. This address is also our point of contact under the Digital Services Act for users and authorities. You can write to us in German or English.
Availability and liability
We do our best to keep Gathery running reliably, but we cannot guarantee that it is always available or that every photo arrives. Photos are deleted automatically 14 days after an event ends; save them before then if you want to keep them. We may change features or discontinue Gathery and will let you know in good time beforehand.
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act (Produkthaftungsgesetz). For slight negligence we are only liable if we breach an essential obligation, meaning an obligation that makes Gathery possible in the first place and on whose fulfilment you may rely, for example that only the host sees the photos of their event. Our liability is then limited to the damage that is typically foreseeable with Gathery. Otherwise we are not liable for slight negligence.
If you culpably breach these terms or the rights of third parties with a photo you have uploaded and third parties therefore assert claims against us, you indemnify us against these claims, including reasonable costs of legal defence.
Changes and applicable law
If we change these terms materially, we will ask for your consent beforehand in the app or on the camera page. If you do not agree, the previous terms continue to apply to you until you delete your account or we terminate the user agreement with four weeks' notice. Minor changes that do not put you at a disadvantage, such as corrections or new features, we will simply tell you about.
German law applies. If you are a consumer living in the EU, you keep the protection of the mandatory provisions of your country.
